Terms of Service

These terms govern the use of FlokiGuide. This is a starter draft and should be reviewed by legal counsel.
1. Scope
These terms apply to consumers (Section 13 BGB) using the FlokiGuide website and related services.
2. Service description
FlokiGuide provides digital tools for trip planning, itinerary generation, and destination exploration.
3. User accounts
- Users are responsible for maintaining the confidentiality of login credentials.
- Users must provide accurate account information.
- Accounts may be suspended in case of misuse or legal violations.
4. Acceptable use
- No unlawful, abusive, or fraudulent use of the service.
- No attempts to disrupt, reverse engineer, or compromise platform security.
- No rights-infringing uploads or content submissions.
5. Availability and changes
The service may be modified, restricted, or interrupted for maintenance, security, or operational reasons.
6. Liability
We are liable without limitation in cases of intent and gross negligence. In cases of slight negligence, we are liable only for breaches of essential contractual obligations (Kardinalpflichten), and limited to the foreseeable damage typical for this type of contract. These limitations do not apply to liability for injury to life, body, or health, to mandatory statutory liability (including product liability law), or where we have expressly assumed a guarantee.
7. Prices and subscriptions
FlokiGuide may offer paid consumer subscriptions. Plan features and pricing are displayed before checkout and in your account area. Subscriptions are billed in advance for the selected billing period. Cancellation takes effect at the end of the current billing period. No pro-rata or partial refunds are provided for unused portions of an active billing period, unless mandatory law requires otherwise.
8. Right of withdrawal (consumers)
Consumers generally have a statutory right of withdrawal of 14 days, unless a statutory exception applies. Where legally permissible, by requesting immediate start of digital services before the end of the withdrawal period, you expressly consent to performance beginning and acknowledge that your withdrawal right may expire once the service has been fully performed. If you validly withdraw after performance has begun, we may charge a proportionate amount for services already provided, where legally permitted.
9. Intellectual property
All platform content, trademarks, and software elements remain the property of Devrupt UG or its licensors unless stated otherwise.
10. Term and termination
Users can delete their account according to available account controls. We may terminate access for material breaches of these terms.
11. Governing law and jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions and mandatory jurisdiction rules remain unaffected. Where legally permissible, the place of jurisdiction is Berlin.
12. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
